1. Acceptance of Terms

By accessing our website, requesting a quote, or engaging DMB Landscaping for any service, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services.

2. Services

DMB Landscaping provides residential and commercial landscaping, landscape design and installation, landscape maintenance, hardscaping, drainage construction, horticultural consultations, and commercial snow removal services throughout Delaware County, Pennsylvania. The specific scope of services for each project will be outlined in a separate written agreement or proposal provided to the client prior to work commencing.

3. Estimates and Quotes

All estimates and quotes provided by DMB Landscaping are based on information available at the time of assessment. Final pricing may be subject to change if site conditions, project scope, or material costs differ materially from what was originally assessed. Any changes to scope or pricing will be communicated to the client in advance and require written approval before additional work proceeds.

4. Payment Terms

Payment terms will be specified in the project proposal or service agreement. DMB Landscaping reserves the right to require a deposit prior to commencing work on larger projects. Invoices are due upon receipt unless otherwise agreed in writing. Accounts that remain unpaid beyond the agreed payment period may be subject to late fees and suspension of service.

5. Client Responsibilities

Clients are responsible for providing accurate information about their property and any conditions that may affect the performance of services. This includes but is not limited to underground utilities, irrigation systems, property boundaries, and any known hazards. DMB Landscaping is not liable for damage resulting from undisclosed conditions.

6. Access to Property

By engaging our services, the client grants DMB Landscaping and its personnel reasonable access to the property as necessary to perform the agreed-upon work. We will make every effort to minimize disruption and leave the property in a clean and orderly condition upon completion.

7. Cancellations and Rescheduling

Clients may cancel or reschedule scheduled services by providing at least 48 hours advance notice. Cancellations made with less than 48 hours notice may be subject to a cancellation fee. DMB Landscaping reserves the right to reschedule services due to weather conditions, equipment issues, or other circumstances beyond our control.

8. Weather and Seasonal Conditions

Certain services, including snow removal, are subject to weather conditions. DMB Landscaping will make reasonable efforts to respond promptly to weather events but cannot guarantee specific response times in extreme or widespread weather conditions. No refunds or penalties will apply for delays caused by circumstances outside our control.

9. Limitation of Liability

DMB Landscaping's liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages of any kind, including lost profits or property damage caused by conditions that were not disclosed to us prior to commencing work.

10. Warranty

DMB Landscaping stands behind the quality of our work. If you are unsatisfied with any aspect of a completed service, please notify us within 7 days of project completion and we will make reasonable efforts to address the issue. Plant material warranties, where applicable, will be specified in the individual project agreement and are subject to the client's proper care and maintenance following installation.

11. Intellectual Property

All content on the DMB Landscaping website — including text, images, logos, and design elements — is the property of DMB Landscaping and may not be reproduced, distributed, or used without express written permission.

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Delaware County, Pennsylvania.

13. Changes to These Terms

DMB Landscaping reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted on our website with a revised effective date. Continued use of our website or services following any changes constitutes acceptance of the updated terms.
